Playground design and planning.

Information published on our website is provided for general guidance. It does not constitute a binding offer to supply products or services unless we expressly state otherwise in writing.
You may use our website for lawful purposes and in accordance with these Terms and Conditions.
You agree not to:
Use the website in breach of any applicable law or regulation.
Attempt to gain unauthorised access to our website, servers or systems.
Introduce viruses, malicious software or other harmful material.
Interfere with the security, functionality or operation of the website.
Copy, reproduce or distribute website content for commercial purposes without our written permission.
Use our website to submit false, misleading or fraudulent enquiries.
We may restrict or suspend access to the website if we reasonably believe that someone has breached these terms or is using the website unlawfully.
We do not guarantee that our website will always be available, uninterrupted or free from errors.
We take reasonable care to ensure that information published on our website is accurate and up to date.
However, product descriptions, photographs, illustrations, specifications, dimensions and other information are provided for general guidance. They may not represent the exact appearance, configuration or specification of equipment supplied for a particular project.
Product availability, specifications, colours, materials and designs may change. We will confirm the relevant details in writing where they form part of an agreed order or contract.
You should not rely solely on general website information when making decisions about a specific installation. Please contact us for project-specific advice and confirmation.
You may contact us to discuss your requirements or request a quotation.
Any quotation we provide will be subject to the scope of work, specifications, pricing, exclusions, payment terms and validity period stated in that quotation.
Unless the quotation states otherwise:
A quotation is not a binding contract until we accept your order or both parties agree to proceed in writing.
Prices may change if you amend the project scope or if the original information supplied was materially incomplete or inaccurate.
Additional work outside the agreed scope may incur extra charges.
Any estimated completion dates remain subject to the assumptions and conditions stated in the quotation.
You are responsible for ensuring that the information you provide is accurate and complete enough for us to assess your requirements.
If site conditions, access restrictions or other relevant circumstances differ from those disclosed before we prepare the quotation, we may need to revise the price, programme or scope of work. We will discuss material changes with you before proceeding with chargeable additional work, except where immediate action is reasonably necessary to address a safety risk or comply with a legal obligation.
A contract for the supply of equipment or services will be formed when we accept your order or when both parties otherwise agree in writing to proceed.
The contract may comprise a quotation, written order confirmation, agreed specification, project schedule and any separate terms supplied for the project.
If these website Terms and Conditions conflict with specific terms agreed in a signed contract or accepted quotation, the specific project terms will take precedence for that project, unless the parties expressly agree otherwise.
We reserve the right to decline an order where we have a reasonable commercial or operational justification.
You must ensure that the person placing an order on behalf of a business or organisation has the authority to do so.
The price of each project will be set out in the relevant quotation or contract.
Unless expressly stated otherwise, prices may exclude VAT, delivery, groundworks, additional materials, site preparation, access equipment, waste removal or other services outside the agreed scope.
Any applicable VAT and additional charges will be identified in the quotation or contract where reasonably possible.
You must pay invoices in accordance with the payment terms agreed in writing.
If you fail to pay an undisputed invoice by its due date, we may, subject to applicable law and the terms of the relevant contract:
Charge interest and recover reasonable costs where legally entitled to do so.
Suspend work or delay further deliveries after giving any notice required by the contract or law.
Seek recovery of outstanding amounts through the appropriate legal process.
If you dispute an invoice, you should notify us promptly, explain the reason and pay any undisputed amount in accordance with the agreed payment terms.
We will not impose additional charges or exercise contractual remedies in a way that conflicts with applicable law.
Changes to an agreed project may affect the price, materials, design, installation method and completion date.
You should request changes in writing. We will confirm any resulting changes to the scope, cost or programme before carrying out additional chargeable work.
We may need to propose changes if we discover unforeseen site conditions, equipment availability issues or other circumstances that materially affect the original specification.
We will discuss proposed changes with you and obtain agreement where required under the contract.
If the parties cannot agree on a material change, their rights and obligations will be determined by the relevant contract and applicable law.
You must provide the access, information and cooperation reasonably required for us to carry out the agreed work.
Depending on the project, your responsibilities may include:
Providing safe and suitable access to the installation site.
Ensuring that the site is available on the agreed dates.
Providing accurate information about the site, including known underground services, drainage, utilities and access restrictions.
Obtaining permissions, approvals and consents allocated to you under the contract.
Arranging suitable site preparation and groundworks where these are outside our agreed scope.
Identifying relevant site hazards and restrictions.
Ensuring that children, members of the public and other unauthorised persons are kept away from active work areas.
Providing access to electricity, water or other facilities where agreed as necessary.
We will explain any specific site requirements relevant to the agreed work.
If we cannot proceed because you have not met an agreed responsibility, we may need to reschedule the work or agree changes to the price and programme. Any additional charges must be consistent with the contract and applicable law.
We will carry out the services in accordance with the agreed specification and contract.
Any delivery, installation or completion dates provided will be treated according to the terms of the relevant quotation or contract. Where dates are estimates, they may change because of factors such as weather, supplier delays, site access, unforeseen ground conditions or other circumstances beyond our reasonable control.
We will notify you of material delays where reasonably practicable and discuss any necessary changes to the project programme.
You must not use newly installed equipment until it is safe and appropriate to do so and any required handover or inspection procedures have been completed.
Where our contract includes installation, we will complete the agreed installation work and provide any handover information expressly included in the contract.
Any inspection, testing, certification or independent assessment must be included in the agreed scope unless otherwise required by law.
Playground equipment must be installed, inspected, maintained and used appropriately to support the safety of its users.
We will carry out our agreed work with reasonable care and skill and in accordance with applicable legal requirements relevant to the services provided.
The customer or site operator remains responsible for the ongoing management of the playground after handover, except to the extent that specific responsibilities remain with us under the contract or applicable law.
Depending on the project and applicable requirements, ongoing responsibilities may include:
Arranging appropriate inspections and maintenance.
Keeping equipment and surrounding areas in a safe condition.
Following relevant manufacturer instructions and maintenance recommendations.
Managing access to the playground.
Addressing hazards, damage or deterioration identified after handover.
Keeping appropriate inspection and maintenance records.
Complying with applicable health and safety obligations.
You must not alter, misuse or modify installed equipment in a way that compromises its safety or breaches the manufacturer's instructions.
If you identify a defect or safety concern, you should stop using the affected equipment where necessary to protect users and contact the relevant responsible party promptly.
If you wish to cancel or reschedule an order or project, you must notify us in writing as soon as possible.
The consequences of cancellation will depend on the relevant quotation, contract, the stage of the project and applicable law.
Where the contract permits cancellation charges, these may reflect reasonable costs already incurred, work completed, materials ordered specifically for the project and other amounts properly recoverable under the contract.
We will not seek to recover cancellation charges where doing so would breach applicable law or the agreed contract.
If we need to cancel or substantially change a project, we will notify you and explain the available options in accordance with the contract and applicable law.
Nothing in this section removes any statutory cancellation or refund rights that apply to a particular customer or transaction.
If you believe that equipment or services do not comply with the agreed contract, please contact us promptly with details of the issue.
Where possible, provide photographs, the project reference and a description of the problem so that we can investigate.
We will assess the issue and, where appropriate, arrange an inspection or propose a remedy in accordance with the contract and applicable law.
Depending on the circumstances, a remedy may include repair, replacement, re-performance of services or another appropriate solution.
You should not arrange substantial remedial work by another contractor at our expense without first notifying us and giving us a reasonable opportunity to investigate, unless immediate action is necessary to address a safety risk or prevent further damage.
Nothing in these terms limits any legal rights or remedies that you cannot lawfully waive.
Where equipment or materials are supplied with a manufacturer's warranty, the applicable warranty terms will govern the manufacturer's warranty.
We will provide relevant warranty information where it forms part of the agreed supply or contract.
A manufacturer's warranty may be subject to conditions concerning installation, inspection, maintenance, normal wear and tear, misuse and unauthorised alterations.
Any separate warranty provided by us will be governed by its stated terms.
No warranty under these terms excludes or replaces any statutory rights that apply to the relevant transaction.
Unless otherwise stated, the intellectual property rights in the content of our website belong to Celtic Developments Ltd or are used under licence.

You may view and use website content for your personal or internal business purposes when considering our services.
You must not reproduce, distribute, modify, publish or commercially exploit our website content without our prior written permission, except where applicable law permits such use.
Any designs, plans, drawings, specifications or project documents created specifically for a customer will be subject to the intellectual property terms agreed for that project.
Our projects may involve products, equipment, materials or services supplied by third parties.
Where a third party provides a product warranty or service guarantee, the applicable terms will govern that warranty or guarantee.
We remain responsible for our own contractual obligations and will not exclude any liability that the law requires us to retain.
We are not responsible for independent third-party websites linked from our website. Accessing those websites is at your own discretion and subject to their own terms and privacy policies.
We will perform our contractual obligations with reasonable care and skill and in accordance with applicable law.
Nothing in these Terms and Conditions excludes or limits liability where such exclusion or limitation is prohibited by law.
In particular, nothing in these terms limits liability for:
Death or personal injury caused by negligence.
Fraud or fraudulent misrepresentation.
Any other liability that cannot lawfully be excluded or limited.
Subject to the above, we will only be liable for losses that arise as a reasonably foreseeable result of our breach of contract, negligence or other actionable conduct, in accordance with applicable law.
Where legally permitted, we will not be liable for indirect or consequential losses that were not reasonably foreseeable when the relevant contract was formed.
Where the customer contracts with us in the course of business, any additional limitations of liability must be expressly agreed in the relevant contract and must comply with applicable law.
Nothing in these terms affects consumer rights or statutory remedies that apply where a customer qualifies as a consumer.
We will not be responsible for delays or failures caused by circumstances beyond our reasonable control, to the extent permitted by law and subject to the relevant contract.
Such circumstances may include severe weather, flooding, fire, industrial action, transport disruption, supplier failures, government restrictions, public emergencies or other events that materially prevent us from carrying out the agreed work.
Where such an event affects a project, we will notify you where reasonably practicable and take reasonable steps to reduce the impact.
If the disruption continues, the parties will discuss the available options under the relevant contract.
This section does not remove any payment, cancellation or other rights that cannot lawfully be excluded.
